Terms & Conditions

These Terms and Conditions (“Terms”) govern your use of this website and any quotation, order or sale of goods and services made through it. Please read them before requesting a quotation or placing an order.

1. Who we are

This website is operated by T-Four Investments Limited, trading as T4 Pumps Zambia (“T4 Pumps”, “we”, “us”, “our”), a company registered in the Republic of Zambia [company registration number to be confirmed].

  • Registered office: Plot No. 43, Katima Mulilo Road, Olympia, Lusaka, Zambia
  • Telephone: +260 97 492 4559
  • Email: kris@t4pumps.com

2. Acceptance of these Terms

By browsing this website, requesting a quotation, creating an account or placing an order, you confirm that you accept these Terms and that you agree to them. If you do not agree, please do not use the site.

If you are placing an order on behalf of a business, you confirm that you have authority to bind that business, and these Terms apply to that business.

3. Products and technical information

We supply pumps, motors, control equipment, pipework and related spares. Product descriptions, curves, dimensions, materials, power ratings and other technical data published on this site are provided for general guidance and are drawn from manufacturer documentation. They are indicative and do not form part of any contract unless expressly confirmed in writing in a quotation or order confirmation.

Images are illustrative. Manufacturers may change specifications, finishes or packaging without notice.

Any sizing, selection or application advice we provide — whether on this site, by telephone, by email or in person — is offered in good faith on the basis of the information you give us. It remains your responsibility to satisfy yourself that the equipment selected is suitable for your duty point, fluid, site conditions and applicable standards.

4. Quotations and “Price on request”

Most items in our catalogue are shown as Price on request rather than with an online price. For these items the website does not sell to you directly: you submit a request and we respond with a written quotation.

  • A quotation is an invitation to treat and does not create a contract until we issue a written order confirmation or proforma invoice.
  • Quotations are valid for [validity period to be confirmed, e.g. 14 days] from the date of issue unless stated otherwise on the quotation itself.
  • Quotations are based on the quantities, specification and delivery requirements you supply. If those change, the quotation may be revised.
  • Where goods are imported, quotations may be subject to change in the event of movements in exchange rates, freight costs, duties or manufacturer pricing before an order is confirmed.

5. Prices, taxes and currency

Where prices are displayed on this site they are shown in Zambian Kwacha (ZMW).

Prices are [inclusive / exclusive — to be confirmed] of Value Added Tax. Any VAT, duties, levies or other taxes properly chargeable will be shown on the quotation and invoice. [T4 Pumps TPIN and VAT registration status to be confirmed.]

Unless a quotation states otherwise, prices exclude delivery, offloading, installation, commissioning and any site works.

We take care to ensure prices shown are correct. If we discover a manifest error in the price of goods you have ordered, we will contact you before dispatch and you may confirm the order at the corrected price or cancel it.

6. Orders and acceptance

Placing an order — whether online, by email, by telephone or against a quotation — constitutes an offer by you to purchase on these Terms. No contract exists until we accept your order in writing by order confirmation, proforma invoice or dispatch of the goods, whichever occurs first.

We may decline an order, in whole or in part, including where the goods are unavailable, where a pricing or description error has occurred, where we cannot obtain authorisation for payment, or where we are unable to supply to your location.

7. Availability and stock

Stock indications shown on the site are drawn from our inventory system and are indicative only. They are not a guarantee that an item is physically available at the time you order. Lead times for items shown as available on order will be confirmed in your quotation or order confirmation.

8. Payment

We currently accept:

  • Bank transfer (EFT) — our banking details are provided on the quotation or proforma invoice. Please quote your order or invoice number as the payment reference.
  • Payment on delivery or collection — where agreed in advance in writing.

Unless credit terms have been agreed in writing, goods are supplied against payment in full in cleared funds before dispatch or collection. Where credit terms apply, payment is due within the period stated on the invoice, and we reserve the right to charge interest on overdue amounts at [rate and basis to be confirmed].

We do not currently take card payments through this website. You should never send card details or full banking credentials to us by email.

9. Delivery, risk and title

We deliver across Zambia. Delivery timescales quoted are estimates given in good faith and are not guaranteed unless expressly agreed in writing as a condition of the contract.

Unless agreed otherwise, you are responsible for providing safe access, and for offloading goods at the delivery address. Heavy items may require suitable lifting equipment.

Risk in the goods passes to you on delivery to the address you specify, or on collection. Title to the goods does not pass to you until we have received payment in full of all amounts due in respect of them.

Please inspect goods on arrival. Shortages, incorrect items or visible transit damage should be noted at the point of delivery and reported to us in writing within [notification period to be confirmed, e.g. 7 days].

10. Cancellation, returns and refunds

Requests to cancel or amend a confirmed order must be made in writing and are subject to our acceptance. Goods that have been specially ordered, imported to your specification, built to order or cut to length are not cancellable or returnable once the order is confirmed.

Where a return is accepted, goods must be unused, in their original packaging and in resaleable condition. A handling or restocking charge may apply. Returns handling is set out in our Refund and Returns Policy, which forms part of these Terms.

11. Warranty

Goods are supplied with the manufacturer’s warranty applicable to the product. Warranty periods and conditions vary by manufacturer and product and will be confirmed on your quotation or invoice. Details are set out on our Warranty page.

Warranty cover is generally void where equipment has been incorrectly selected for the duty, incorrectly installed, run dry, operated outside its rated envelope, connected to an unsuitable electrical supply, or repaired or modified by anyone not authorised by us or by the manufacturer.

Nothing in these Terms excludes or limits your rights under the Competition and Consumer Protection Act of Zambia or any other statutory rights that cannot lawfully be excluded.

12. Installation, commissioning and safety

Pumps, motors and control equipment must be installed, electrically connected and commissioned by suitably qualified persons in accordance with the manufacturer’s instructions and applicable Zambian standards and regulations. Unless we have expressly contracted to carry out installation or commissioning, we are not responsible for that work or for its consequences.

13. Accounts

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Please tell us promptly if you believe your account has been used without your authority. We may suspend or close an account where these Terms have been breached.

14. Acceptable use of this website

You agree not to use this site unlawfully, not to attempt to gain unauthorised access to it, not to introduce malicious code, and not to extract or reproduce our catalogue data systematically for commercial purposes without our written consent.

15. Intellectual property

All content on this site — including text, layout, graphics, photographs and the T4 Pumps name and logo — is owned by or licensed to T-Four Investments Limited and is protected by intellectual property law. Manufacturer names, brands and logos remain the property of their respective owners and are used to identify the products we supply.

You may view, download and print pages for the purpose of evaluating or purchasing our products. Any other use requires our prior written permission.

16. Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

Subject to that, we are not liable for loss of profit, loss of production, loss of contracts, loss of anticipated savings, downtime, or any indirect or consequential loss, however arising. Our total liability arising out of or in connection with any contract, whether in contract, tort (including negligence) or otherwise, is limited to the price paid for the goods giving rise to the claim.

This clause does not affect the manufacturer’s warranty referred to above.

17. Third-party links

This site may link to third-party websites, datasheets or manufacturer resources. Those sites are not under our control and we accept no responsibility for their content or availability.

18. Privacy and cookies

Personal information you provide — including when you request a quotation or download a datasheet — is handled in accordance with our Privacy Policy. Our use of cookies is described in our Cookie Policy.

19. Events beyond our control

We are not liable for any delay or failure to perform where it is caused by events beyond our reasonable control, including but not limited to shipping and customs delays, supplier or manufacturer failure, industrial action, power or communications failure, extreme weather, or acts of government.

20. Changes to these Terms

We may update these Terms from time to time. The version published on this page at the time you place an order is the version that applies to that order. Please review this page before ordering.

21. Governing law and jurisdiction

These Terms and any contract formed under them are governed by the laws of the Republic of Zambia, and the courts of Zambia have exclusive jurisdiction.
